California Penal Code 261.5 makes it a crime to have sexual intercourse with a person under 18 who is not the accused’s spouse. The statute uses the legal term “unlawful sexual intercourse,” though the charge is widely known as statutory rape. What makes this offense distinct is that the alleged victim’s consent, willingness, or even initiation of the activity is not a defense. Minors are legally considered incapable of consenting to sexual intercourse, so those facts don’t enter the analysis.

To secure a conviction, prosecutors must prove beyond a reasonable doubt that intercourse occurred, that the parties were not married, and that the alleged victim was under 18 at the time. This charge is legally distinct from forcible rape under Penal Code 261, which requires force, fear, or threats. Penal Code 261.5 requires none of those elements.

How the Age Gap Determines the Charge Level

The age difference between the accused and the minor is the single biggest variable in how a Penal Code 261.5 case is filed. California breaks it into three tiers.

Three years or fewer: If the accused is not more than three years older than the minor, the offense is typically a misdemeanor, punishable by up to six months in county jail and a fine of up to $1,000.
More than three years: If the accused is more than three years older, the charge becomes a wobbler, meaning it can be filed as either a misdemeanor or a felony. Felony penalties run from 16 months to three years in state prison.
Accused 21 or older, minor under 16: When these ages align, felony penalties increase to two, three, or four years in state prison.

California has not enacted a “Romeo and Juliet” law exempting closely aged couples from prosecution. A small age gap reduces the potential penalty, but it doesn’t eliminate criminal exposure. The wobbler classification in the middle tier is where prosecutorial discretion matters most, and it’s precisely where former-prosecutor perspective shapes how we approach a case.

A Penal Code 261.5 conviction can carry civil penalties separate from any criminal sentence, ranging from $2,000 to $25,000 depending on the age difference between the parties.

Unlike a conviction for forcible rape, a statutory rape conviction doesn’t typically require registration as a sex offender under Penal Code 290, a distinction that matters for someone’s long-term future. That said, depending on the minor’s age and how the offense is charged, a conviction can still carry serious immigration consequences for non-citizens. Federal immigration law treats sex offenses involving minors harshly, and a felony conviction under this statute may expose a non-citizen to removal proceedings.
