Filing Deadlines You Can’t Afford to Miss
The standard EEOC charge deadline is 180 days from the discriminatory act. On the state side, California’s CRD allows three years from the discriminatory act to file a complaint under the Fair Employment and Housing Act (FEHA), following the 2020 SHARE Act extension. One practical advantage in California: filing with either the EEOC or the CRD typically results in the charge being automatically dual-filed with both agencies under a worksharing agreement, so you don’t have to file twice. Once the EEOC issues a Notice of Right-to-Sue, you generally have 90 days to file in federal court.
How the EEOC Charge Process Works
The process begins with an inquiry submitted through the EEOC Public Portal. From there, you’ll participate in a phone, video, or in-person interview at an EEOC office, after which the charge is formally drafted and filed. The EEOC then notifies your employer, conducts an investigation, and may attempt to mediate a resolution. If the matter doesn’t resolve, you can request a Notice of Right-to-Sue, which opens the door to a civil lawsuit.
That interview and charge-drafting stage matters more than most employees realize. How the charge is written shapes the scope of any lawsuit that follows, and claims left out of the charge can be difficult to add later.
