FAQ #11: Can I Get a DUI for an Open Container?

If you're pulled over and you have an open container of alcohol in the car, it may or may not result in a DUI. It's guaranteed to result in a citation for the open container, even if it's just your passenger in the front seat or even the back seat.

It's also going to be probable cause to pull you out of that car and conduct more investigation into whether you are driving under the influence of alcohol.

If your blood alcohol comes back at a .08 or greater, that open container is going to be Exhibit A at the courthouse.
